Ministry of the Environment – Draft Regulation on the Classification of Ecosystems by Conservation Status and the Development of Management Plans for the Conservation of Threatened Ecosystems, Submitted for Public Consultation.

On February 17, 2025, Exempt Resolution No. 801 of February 5, 2025, was published in the Official Gazette, approving the Draft Regulation that governs the classification of ecosystems based on conservation status and the development of management plans for the conservation of threatened ecosystems, in accordance with Articles 30 and 31 of Law No. 21.600, which creates the Biodiversity and Protected Areas Service and the National System of Protected Areas, known as the SBAP Law.

 

This Draft Regulation is subject to public consultation, allowing individuals and legal entities to submit comments on its content within 30 business days, until March 31, 2025.

 

Key Aspects Regulated by the Draft Regulation

 

Objective: Establishes the content and procedure for classifying ecosystems based on their conservation status, as well as for issuing management plans for the conservation of threatened ecosystems.

 

Effective Date: The regulation will come into force upon its publication in the Official Gazette.

 

Conservation Categories: Adopts the conservation categories recommended by the International Union for Conservation of Nature (IUCN), which include: "Collapsed," "Critically Endangered," "Endangered," "Vulnerable," "Near Threatened," "Least Concern," and "Data Deficient."

 

Management Plans: Applicable to ecosystems classified as "Critically Endangered," "Endangered," "Vulnerable," and "Near Threatened."

 

Implementation and Oversight of Management Plans: The Biodiversity and Protected Areas Service will be responsible for coordinating the implementation of management plans, which may also be carried out by other sectoral agencies or by individuals and legal entities, both public and private, through specific agreements. Additionally, the Service will oversee and monitor compliance with these management plans.

 

Public Consultation: Comments on this Draft Regulation must be well-founded and submitted through the website http://consultasciudadanas.mma.gob.cl, or in writing at the Ministry of the Environment or at the Regional Ministerial Secretariats of the Ministry of the Environment corresponding to the interested party's residence.
