On Friday, February 27, 2026, the Urban Development Division of the Ministerio de Vivienda y Urbanismo issued DDU No. 533, providing instructions for the uniform application of the extraordinary 18-month extension applicable to certain construction permits, as established by Supreme Decree No. 33 of 2024 of the same Ministry, which incorporated a transitional provision into the General
- Background.
Supreme Decree No. 33 of 2024, published in the Official Gazette on September 30, 2024, added a transitional provision to the OGUC expressly establishing that construction permits which were in force as of the entry into effect of that regulation and for which works had not yet commenced shall be deemed extended for an additional 18 months (the “Extraordinary Extension”).
- Scope of Application
DDU No. 533 clarifies that the Extraordinary Extension applies only to construction permits that cumulatively meet the following requirements:
- a) The permit must have been in force as of the entry into effect of Supreme Decree No. 33, that is, as of its publication in the Official Gazette; and
- b) As of that date, the works must not have commenced—meaning that layout markings must not have been carried out and excavation works contemplated in the project plans must not have begun.
Accordingly, the Extraordinary Extension does not apply to construction permits that were not in force as of September 30, 2024, nor to those that, although in force, had already commenced works.
- Calculation of the Extraordinary Extension.
DDU No. 533 further establishes an express criterion for calculating the Extraordinary Extension. It clarifies that the expression “extended for eighteen additional months” must be understood as an extension added to the remaining validity period of the permit as of September 30, 2024, provided that the aforementioned requirements are met. The circular also includes illustrative examples confirming that the additional term is fully added to the existing remaining period, regardless of the length of such remaining period.
