{"id":6688,"date":"2026-09-09T19:54:54","date_gmt":"2026-09-09T22:54:54","guid":{"rendered":"https:\/\/jdf.cl\/?p=6688"},"modified":"2026-09-09T19:54:54","modified_gmt":"2026-09-09T22:54:54","slug":"ley-de-urbanismo-y-construcciones-criterios-regionales-para-cautelar-amenazas-naturales-y-antropicas","status":"publish","type":"post","link":"https:\/\/jdf.cl\/en\/ley-de-urbanismo-y-construcciones-criterios-regionales-para-cautelar-amenazas-naturales-y-antropicas\/","title":{"rendered":"Urban Planning and Construction Law: Regional Criteria for Mitigating Natural and Anthropogenic Threats"},"content":{"rendered":"<p>On September 8, 2026, Exempt Resolution No. 768, dated August 26, 2026, issued by the Regional Ministerial Secretariat of Housing and Urban Development of the Coquimbo Region, was published in the Official Gazette. This resolution amends Exempt Resolution No. 550, dated August 31, 2021, which establishes regional criteria to safeguard compliance with the provisions of the second paragraph of Article 55 of the General Urban Planning and Construction Law (Ley General de Urbanismo y Construcciones, \u201cLGUC\u201d) in the Coquimbo Region.<\/p>\n<p>The Resolution seeks to strengthen the regional criteria applicable to projects seeking to qualify for the exceptions provided for in Article 55 of the LGUC, particularly with respect to territorial vulnerability, disaster risk management, and surrounding risks. The amendment seeks to ensure that the assessment of such projects takes into consideration natural and anthropogenic hazards, climate-related risks, accessibility conditions, and the project\u2019s compatibility with the planning and territorial management instruments currently in force.<\/p>\n<p>The main amendments introduced by the Resolution are as follows:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong><u>Amendment to letter c) of numeral 1 of Exempt Resolution No. 550, dated August 31, 2021<\/u>. <\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Letter c) of numeral 1 of Exempt Resolution No. 550 is replaced by the following: \u201cc) VULNERABILITY, DISASTER RISK MANAGEMENT AND SURROUNDING RISKS.\u201d\nThis provision establishes that all projects must avoid being located in areas exposed to natural or anthropogenic hazards that could compromise the safety of persons, property, infrastructure, essential services, or the proper functioning of the territory.<\/p>\n<p>For these purposes, the assessment must consider, among others, risks associated with flooding, waterlogging, overflowing and active ravines, mass movements, mudflows, erosion, subsidence, forest fires, storm surges, tsunamis, severe drought, desertification, risks arising from climate change, and risks identified by technical agencies responsible for hazard monitoring.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li><strong><u>Technical information required for areas exposed to risks<\/u><\/strong><strong>.<\/strong><\/li>\n<\/ol>\n<p>Where a project is located in an area in which the existence or susceptibility to risks is established in a territorial planning instrument, identified in the Preliminary Information Certificate (Certificado de Informaciones Previas) issued by the Municipal Works Department, or contained in official cartography, such as hazard or risk maps, technical information prepared by a qualified professional must be included in the project\u2019s Explanatory Report.<\/p>\n<p>Such technical information must demonstrate the following:<\/p>\n<ol>\n<li>The identification and characterization of present and future hazards.<\/li>\n<li>The assessment of the exposure and vulnerability of buildings, infrastructure, and potentially affected populations.<\/li>\n<li>The project\u2019s compatibility with the instruments, plans, and official cartography relating to Disaster Risk Management, Climate Change, and Territorial Planning currently in force.<\/li>\n<li>The existence of adequate accessibility conditions for evacuation, emergency response, and the operational continuity of basic services.<\/li>\n<li>The mitigation, adaptation, or risk-reduction measures required to safeguard the safety of persons and reduce territorial vulnerability.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><strong><u>Coordination with other government and administrative authorities<\/u><\/strong><strong>.<\/strong><\/li>\n<\/ol>\n<p>The assessment conducted by the Regional Ministerial Secretariat of Housing and Urban Development of the Coquimbo Region may include consultations with other competent authorities, such as the National Disaster Prevention and Response Service (Servicio Nacional de Prevenci\u00f3n y Respuesta ante Desastres, \u201cSenapred\u201d), the General Water Directorate (Direcci\u00f3n General de Aguas), Sernageomin, Conaf, the Chilean Meteorological Directorate (Direcci\u00f3n Meteorol\u00f3gica de Chile), the Ministry of Public Works, and other competent sectoral authorities, as applicable.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"4\">\n<li><strong><u>Limitations on the sufficiency of mitigation measures<\/u><\/strong><strong>.<\/strong><\/li>\n<\/ol>\n<p>The mere submission of mitigation measures will not be sufficient for project approval where the magnitude of the residual risk is incompatible with the safe and resilient development of the territory, where the proposed measures may generate or increase risks or negative externalities for surrounding communities, infrastructure, services, or territories, or where the project may contribute to the development of new urban settlements outside the framework of intermunicipal urban planning.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"5\">\n<li><strong><u>Entry into force<\/u>.<\/strong><\/li>\n<\/ol>\n<p>The amended criteria will apply to applications submitted after the publication of the Resolution in the Official
