{"id":6176,"date":"2026-02-24T16:28:34","date_gmt":"2026-02-24T19:28:34","guid":{"rendered":"https:\/\/www.jdf.cl\/?p=6176"},"modified":"2026-02-24T16:28:34","modified_gmt":"2026-02-24T19:28:34","slug":"publicacion-de-la-ley-que-regula-la-extraccion-de-aridos","status":"publish","type":"post","link":"https:\/\/jdf.cl\/en\/publicacion-de-la-ley-que-regula-la-extraccion-de-aridos\/","title":{"rendered":"PUBLICATION OF LAW REGULATING THE EXTRACTION OF AGGREGATES"},"content":{"rendered":"<p class=\"translation-block\">Today, February 24, Law No. 21,800 (the \u201cLaw\u201d), regulating the extraction of aggregates (\u00e1ridos) and amending various legal provisions, was published in the Official Gazette. The purpose of the Law is to regulate the extraction and transportation of aggregates, the certificate of origin, traceability requirements, prohibited zones, oversight mechanisms, and mine closure plans.<\/p>\n<p>The key aspects of the Law are summarized below:<\/p>\n<ol>\n<li><strong><u>Scope of Application<\/u><\/strong><\/li>\n<\/ol>\n<p class=\"translation-block\">With respect to aggregate extraction activities, the Law applies to operations carried out in natural riverbeds that are not navigable by vessels exceeding one hundred tons, as well as in the adjacent regulatory zone to such riverbeds.\nThis regulatory zone generally consists of a 100-meter-wide area running parallel and surrounding the natural riverbed, including the surface and subsoil, whether publicly or privately owned.<\/p>\n<p>Notwithstanding the foregoing, regarding traceability obligations, the Law establishes requirements that apply regardless of the source of extraction of the material.<\/p>\n<ol start=\"2\">\n<li><strong><u>New Authorization Procedure for Aggregate Extraction<\/u><\/strong><\/li>\n<\/ol>\n<p class=\"translation-block\">If the procedure concludes favorably, the DOH will issue the corresponding technical extraction authorization resolution, which will establish the technical conditions for project execution, as well as additional requirements applicable to mechanized extractions\u2014i.e., those carried out using heavy machinery\u2014such as:<\/p>\n<p>En caso de que dicho procedimiento concluya favorablemente, la DOH emitir\u00e1 la correspondiente <u>resoluci\u00f3n de habilitaci\u00f3n t\u00e9cnica de extracci\u00f3n<\/u>, la cual contendr\u00e1 las condiciones t\u00e9cnicas para la ejecuci\u00f3n del proyecto, adem\u00e1s de otros aspectos asociados a las extracciones mecanizadas -esto es, aquellas realizadas por medio de maquinaria pesada-, tales como los montos de las garant\u00edas que deber\u00e1 entregar el titular a la DOH, y los t\u00e9rminos del plan de cierre de la faena.<\/p>\n<p>Una vez notificada dicha resoluci\u00f3n, deber\u00e1 procederse al pago de los derechos municipales que correspondan, a fin de que <u>la municipalidad respectiva autorice la extracci\u00f3n de \u00e1ridos mediante decreto alcaldicio<\/u>. Trat\u00e1ndose de extracciones mecanizadas, ser\u00e1 requisito adicional presentar ante la autoridad municipal copia del certificado de recepci\u00f3n de las garant\u00edas emitido por la DOH.<\/p>\n<ol start=\"3\">\n<li><strong><u>The Law creates a public database to be managed by the DOH, in which information relating to aggregate extraction activities will be recorded, including, among others:\n\u2022\tFavorable or unfavorable technical authorization resolutions; and\n\u2022\tProhibited aggregate extraction zones determined by the DOH in accordance with the Law.<\/u><\/strong><\/li>\n<\/ol>\n<p>Consiste en una base de datos de car\u00e1cter p\u00fablico que estar\u00e1 a cargo de la DOH, en la que se registrar\u00e1 la informaci\u00f3n relativa a las extracciones de \u00e1ridos, incluyendo, por ejemplo, las resoluciones de habilitaci\u00f3n t\u00e9cnica favorables o desfavorables, as\u00ed como las zonas de prohibici\u00f3n de extracci\u00f3n de \u00e1ridos que determine la DOH, en conformidad con la Ley.<\/p>\n<ol start=\"4\">\n<li><strong><u>Certificate of Origin and Traceability Obligations<\/u><\/strong><\/li>\n<\/ol>\n<p class=\"translation-block\">All aggregate material, regardless of its source, must have a certificate of origin issued by the extraction project holder, certifying that the material originates from an authorized source.\nFor aggregates obtained from sources not directly regulated by the Law, a copy of the respective authorization will suffice and will have the same validity as the certificate of origin.<\/p>\n<p class=\"translation-block\">Additionally, the Law imposes traceability obligations associated with the certificate of origin. These obligations apply not only to extraction activities, but also to the commercialization and transportation of aggregates, as well as to construction projects.<\/p>\n<ol start=\"5\">\n<li><strong><u>Infractions and Criminal Offenses<\/u><\/strong><\/li>\n<\/ol>\n<p class=\"translation-block\">Violations arising from non-compliance with traceability obligations are subject to fines that may reach up to 100 Monthly Tax Units (\u201cUTM\u201d), and, in case of repeated offenses, up to 200 UTM.<\/p>\n<p class=\"translation-block\">Unauthorized aggregate extraction or extraction carried out without the required technical authorization, as well as serious breaches of extraction conditions, may be sanctioned with fines of up to 1,000 UTM.<\/p>\n<p class=\"translation-block\">Furthermore, the Law criminalizes the falsification of traceability documentation and illegal aggregate extraction, establishing penalties of imprisonment in its minimum to medium degree and, in the case of falsification, an additional fine of up to 200 UTM.\nThe Law also amends Ley N\u00b021.595 on economic crimes, incorporating these offenses as second-category economic crimes.<\/p>\n<ol start=\"6\">\n<li><strong><u>Entry into force:<\/u><\/strong><\/li>\n<\/ol>\n<p class=\"translation-block\">The Law will enter into force one year after its publication in the Official Gazette.
