{"id":6022,"date":"2025-12-18T14:23:18","date_gmt":"2025-12-18T17:23:18","guid":{"rendered":"https:\/\/www.jdf.cl\/?p=6022"},"modified":"2025-12-18T14:23:18","modified_gmt":"2025-12-18T17:23:18","slug":"nueva-norma-de-emision-de-contaminantes-para-plantas-de-harina-y-aceite-de-pescado-y-de-alimento-para-peces","status":"publish","type":"post","link":"https:\/\/jdf.cl\/en\/nueva-norma-de-emision-de-contaminantes-para-plantas-de-harina-y-aceite-de-pescado-y-de-alimento-para-peces\/","title":{"rendered":"New Emission Standard for Pollutants from Fishmeal, Fish Oil, and Fish Feed Plants"},"content":{"rendered":"<p>On December 17, 2025, Supreme Decree No. 23 of 2024 was published in the Official Gazette, establishing the Emission Standard for pollutants from fishmeal and fish oil plants and fish feed plants, applicable to those facilities which, due to their odors, cause nuisance and pose a risk to the population\u2019s quality of life.<\/p>\n<p>&nbsp;<\/p>\n<p>The main aspects of the new emission standard are as follows:<\/p>\n<p>&nbsp;<\/p>\n<p class=\"translation-block\">Territorial Scope and Regulated Sources: The emission standard applies nationwide and covers the following emission sources:<\/p>\n<ul>\n<li>Plantas de elaboraci\u00f3n y procesamiento de harina y aceite de pescado, y<\/li>\n<li>Fish feed production plants that use, as raw material, an amount equal to or greater than 500 tons per month of biomass, including waste.<\/li>\n<\/ul>\n<p>For the purposes of applying the standard, a distinction is made between existing emission sources and new emission sources, depending on their status as of the date the decree enters into force.<\/p>\n<p><strong><u>Odor Emission Limits and Compliance Deadlines<\/u><\/strong><strong>: <\/strong><\/p>\n<ul>\n<li class=\"translation-block\">Existing emission sources: must comply with the odor emission limits set forth in Table No. 1 of Article 4 within a period of four years from the entry into force of the decree.<\/li>\n<\/ul>\n<p>New emission sources: must comply, from the start of operations, with the odor emission limits set forth in Table No. 2 of Article 4, determined based on maximum odor impact.<\/p>\n<ul>\n<li><strong>Fuentes emisoras nuevas<\/strong>: deber\u00e1n cumplir, desde el inicio de su operaci\u00f3n, con l\u00edmites de emisi\u00f3n de olor asociados a la Tabla N\u00b02 del art\u00edculo 4\u00b0, determinados en funci\u00f3n del impacto odorante m\u00e1ximo.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><u>Medici\u00f3n, modelaci\u00f3n y verificaci\u00f3n del cumplimiento<\/u><\/strong>: La norma establece un sistema de medici\u00f3n de emisiones de olor, utilizando normas t\u00e9cnicas oficialmente homologadas en Chile, junto con modelaci\u00f3n de dispersi\u00f3n atmosf\u00e9rica, con el objeto de determinar el impacto odorante m\u00e1ximo sobre los receptores ubicados dentro del \u00e1rea de influencia.<\/p>\n<p>La Superintendencia del Medio Ambiente verificar\u00e1 las mediciones y modelaciones presentadas por los titulares y fijar\u00e1, mediante resoluci\u00f3n, el l\u00edmite de emisi\u00f3n de olor que permita cumplir el impacto odorante m\u00e1ximo, seg\u00fan sea el caso.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"translation-block\">Mandatory Operational Practices\nIn order to minimize odor emissions, the standard requires both existing and new emission sources to comply with various mandatory operational practices. Information regarding such practices must be submitted within one year from the entry into force of the standard.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Pr\u00e1cticas operacionales obligatorias<\/u><\/strong>: Con el objeto de minimizar las emisiones de olor, la norma exige a las fuentes emisoras, tanto existentes como nuevas, el cumplimiento de diversas pr\u00e1cticas operacionales, cuya informaci\u00f3n a deber\u00e1 ser entregada en el plazo de 1 a\u00f1o desde la entrada en vigencia de la norma.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"translation-block\">Monitoring and Sanctions\nThe control, monitoring, and sanctioning of compliance with all obligations established under the standard will be carried out by the Environmental Superintendence, in accordance with Article Two of Law No. 20,417.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Supervision and sanction:<\/u><\/strong>: El control, fiscalizaci\u00f3n y sanci\u00f3n del cumplimiento de todas las obligaciones establecidas en la norma corresponder\u00e1 a la Superintendencia del Medio Ambiente, de conformidad con \u00a0el art\u00edculo segundo de la Ley N\u00b020.417.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"translation-block\">Entry into Force\nSupreme Decree No. 23 will enter into force six months after its publication in the Official Gazette.If you require additional information on this matter, you may contact:\nJavier Naranjo (jnaranjo@jdf.cl);\nMart\u00edn Esser (messer@jdf.cl);\nAndrea Gallyas (agallyas@jdf.cl);\nMar\u00eda Paz Valenzuela (mpvalenzuela@jdf.cl);
