{"id":5992,"date":"2025-11-27T10:43:16","date_gmt":"2025-11-27T13:43:16","guid":{"rendered":"https:\/\/www.jdf.cl\/?p=5992"},"modified":"2025-11-27T10:56:01","modified_gmt":"2025-11-27T13:56:01","slug":"avance-en-la-tramitacion-ambiental-nueva-medida-del-servicio-de-evaluacion-ambiental-que-busca-agilizar-la-tramitacion-sectorial-de-permisos-ambientales","status":"publish","type":"post","link":"https:\/\/jdf.cl\/en\/avance-en-la-tramitacion-ambiental-nueva-medida-del-servicio-de-evaluacion-ambiental-que-busca-agilizar-la-tramitacion-sectorial-de-permisos-ambientales\/","title":{"rendered":"Progress in Environmental Permitting: New Measure by the Environmental Assessment Service to Streamline Sectoral Environmental Permits"},"content":{"rendered":"<p>Con fecha 24 de noviembre de 2025, el Servicio de Evaluaci\u00f3n Ambiental (SEA) anunci\u00f3 la implementaci\u00f3n de una nueva medida, la <strong><u>emisi\u00f3n autom\u00e1tica de Certificados de Permisos Ambientales Sectoriales<\/u><\/strong> (\u201cPAS\u201d) en proyectos ingresados al Sistema de Evaluaci\u00f3n de Impacto Ambiental (\u201cSEIA\u201d), que cuenten con una Resoluci\u00f3n de Calificaci\u00f3n Ambiental (\u201cRCA\u201d) favorable.<\/p>\n<p>&nbsp;<\/p>\n<p>This new document will be incorporated directly into each project\u2019s electronic file and is intended to certify\u2014quickly and in a standardized manner\u2014that the environmental requirements associated with the PAS were duly evaluated and verified during the environmental impact assessment process. This avoids duplicity of criteria among other agencies involved in the matter and facilitates sectoral permitting procedures.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"translation-block\">This initiative is part of the SEA\u2019s Technological Modernization Plan and the implementation of the new Framework Law on Sectoral Permits, which aims to reduce project processing times, unify criteria, and provide greater legal certainty.<\/p>\n<p>&nbsp;<\/p>\n<p>Indeed, this represents progress in strengthening coordination between the SEA and the State Administration Bodies with Environmental Competence (OAECA), allowing these authorities to accept compliance with environmental and technical requirements without re-evaluating criteria that have already been reviewed.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong><u>Entry into Force and Practical Application<\/u><\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>This new system is already in operation and was launched with the issuance of favorable RCAs for three projects:(i) modernization of the Hern\u00e1n Videla Lira Smelter;\n(ii) the carbon-neutral fuels plant Cabo Negro in Magallanes; and\n(iii) the Kimal \u2013 Lo Aguirre electric transmission line.<\/p>\n<p>&nbsp;<\/p>\n<p>Thus, the PAS Certificates\u2014already communicated via official notice to all OAECA\u2014will be issued to certify that all requirements have been verified as part of the environmental assessment process. It should be noted that each PAS Certificate will share the same validity period as the RCA.<\/p>\n<p>&nbsp;<\/p>\n<p>Accordingly, PAS Certificates will distinguish between two categories:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li class=\"translation-block\">a. Exclusively Environmental PAS, corresponding to permits whose conditions and requirements were fully demonstrated during the SEIA evaluation. In these cases, the OAECA must issue the permit mandatorily, without additional procedures or any application by the project owner\u2014that is, \u201cwithout further processing\u201d.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol>\n<li class=\"translation-block\">b. Mixed PAS, for which the Certificate will attest that the environmental components of the permit were evaluated and verified by the SEA. Consequently, the OAECA may not deny the permit on environmental grounds or impose new environmental conditions; their review must be limited exclusively to sector-specific aspects.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p class=\"translation-block\">If you require additional information on this matter, you may contact: Javier Naranjo (jnaranjo@jdf.cl);
