Environmental Assessment Service Informs About Requirement for Salmonid Fattening Centers to Enter the Environmental Impact Assessment System.

On July 22, 2024, the Environmental Assessment Service ("SEA") issued a report regarding the requirement for Salmonid Fattening Centers ("CES") to enter the Environmental Impact Assessment System ("SEIA") following the sanctioning procedure under File No. D-096-2021. The importance of the report lies in the discussion about the thresholds for maximum authorized production in those CES that began operations prior to the implementation of SEIA, meaning they did not have the respective Environmental Qualification Resolution but had sectoral authorization, i.e., a Technical Project ("PT") from the Undersecretariat of Fisheries and Aquaculture and the respective Aquaculture Concession ("CA") from the Undersecretariat for the Armed Forces. The SEA reports that the PT and the schedule of activities allow for determining the initial situation in which the CES operated. Based on this initial situation, if any holder undertakes works and/or actions intended to increase production levels beyond the 35-ton annual production threshold established in item n.3) of Article 3 of the SEIA Regulations, it would constitute a significant change and, therefore, should be environmentally assessed in the SEIA. Other relevant aspects reported by the SEA include that (i) having a modified PT or a subsequent PT that supports an increase in production over what was initially authorized does not exempt the holder from the obligation to enter the SEIA; and (ii) the basis of the infraction does not correspond to exceeding the maximum limits authorized by the sectoral authority in the PT, but rather to the fact of modifying a hydrobiological resource cultivation project by increasing production levels beyond 35 tons per year.
